CONNECTICUT PROBATE RECORDS

Compiled by Charlou Dolan

 

There are two forms of probate records:  the original documents (usually folded and bound together in packets) and the copies in the assorted record books.  As far as probate courts are concerned, Connecticut is divided into districts, which do not correspond to either the townships or the counties.


Most of the original probate packages were deposited in Hartford, the state capital, where they were alphabetized, numbered and indexed.  After this indexing, the rest of the original records were deposited.  These were placed in their proper alphabetical positions, but they were not given numbers and they are not included in the index.  For the Hartford Probate District, for example, approximately two/thirds of the probate packets are not included in the index.  For this reason I have checked the films for each of the districts to be sure that I have found all the Cadwell probate packages. Only the older probate packages have been filmed.


The recorded probate records are also available, and exist even for some estates where the original documents have been lost.  The assorted will books and administration books have also been filmed for later estates, for which the original documents were not filmed.

Principally I Commit my Soul to God In hopes of the free forgiveness of all my
Sins Through the merits and Blood of the Redeemer and my Body to a Comely
Christian Burial in hopes of a glorious Resurrection at the Last day and as to
the worldly Interests God hath given me I dispose of in manner following my
Debts & funeral Charges being first paid -- Imprimis I give to my beloved wife
Hepzibah Cadwell the Improvements of one third part of my Dwelling house where
I now Live viz on the North part of the Same and also the Improvements of one
third part of all my Improvable Estate with Liberty to Cut her firewood in any
of my woodLand so far as She Shall need for her own fire without making havock
of the same so Long as She Shall Remain my widow--
Item  I give & bequeath to my son John Cadwell the Dwelling house where I now
Live his paying my Just Debts and the Legacies hereafter given.
Item  I give & bequeath to my Son David Cadwell the Dwelling house across the
way from the house above mentioned where David Vibbert now Lives.
Item  I give and bequeath to my Daughter Susannah Risley forty Shillings
Lawfull money to be paid by my Executor hereinafter to be named.

Cadwell & Ann Cadwell Shall Remain if they see fit at the house which I now
Live or that given in this will to my son David Cadwell and Shall have their
support from my Estate Except what they can do to support themselves until
they shall arrive to Eighteen years of Age.

divided between them.

Posess, from the Estate, that my Honoured Mother Died posest of, and also all
the Estate that would accrue to my from my Honoured Grandfather Hubbards
estate, and it is my will that my Executor Provid and Cause Decent Pair of
Tombstones to be set at my Grave, the Cost to come out of what I have given to
said Executor.

Litchfield & state of Connecticutt in New England Being sick & weak in Body
but of perfect mind & memory thanks be given to God - calling to Mind the
mortality of my Body & knowing that it is appointed to all Men Once to Dye, Do
make & Ordain this my Last Will & Testament, That is to say principally &
first of all I give & Recommend my soul into the Hands of God who gave it & my
Body I Recommend to the Earth to be Buried in a decent Christian Burial at the
Discretion of My Executors, not doubting but at the general Resurrection I
shall Recieve the same again by the Almighty Power of God--And as to such
Worldly Estate wherewith it has pleased God to Bless me in this life -- I

my son Ashbel Including my wearing Apparel the half as above.
    Also I give to my Daughter Lydia Berham besides what I have given her Five
Pounds payable out of my Estate.
    Also I give to my Daughter Deborah Cadwell a right in my dwelling House
during her life or so long as she shall see fit. Also I give to her the full
sum of Ten Pounds Lawfull Money payable out of my estate.  The right of my
dwelling House mentioned above is only so far as is convenient for her
Residence in it during her Pleasure.
    Also I do hereby Ordain & appoint my younger son Ashbel Cadwell to be sole
Executor of this my Last Will & Testament & I do hereby utterly disallow,
revoke, & disannull all & every other former Testaments Wills Legacys,
Bequests, & Executors by me in any way before named willed & bequesthed,
Ratifying & Confirming this & no other to be my Last Will & Testament.  In

manner viz finding no personal estate more than to pay the dets & charges of
s'd estate that are risen or may hereafter arise
1st set out to Matthew Cadwell eldest son to the deceased two eaqual parts in
a lot of land containing 8 1/2 acres s'd lot lying in Windsor bounding west on
a highway extending east so far as to make 1 1/2 as afroes'd.

and thanks be to God of enjoying my reason and memory calling to mind the
mortality of my soul and think it my duty to make this my last will and
Testament hereby revoking all former with Principally and First of all I give
my soul into the Hands of God my body also to the Earth to be buried in Decent
Christian burial doubting but at the Resurrection I shall receive the same by
the mighty power of God.  As to my worldly Interest that God has given me
after my Debts and Funeral Charges are paid I give to my wife Mary half my
household furniture one horse and two cows and six sheep Also the use of one

my property to be divided amongst my five sons, Aaron my Eldest son has
received of his portion six hundred and sixty dollars, Roger has received in
money and one year at a trade one hundred and eighty dollars, James has
received fifty Dollars in money, Martin has a deed of seven acres of land the
reduction for him as the land may be priced, Samuel has received nothing &
James must have three quarters as much as the others on the account of his
being at a trade near four years  I therefore give & bequeath to my said five
sons all my Estate real & personal except what I have herein given to my said
wife & daughters to be equally divided among them in equal shares deducting
from said shares what my said sons have before received aforesaid, so that
each of my said sons may have an equal share including what they have before
received as aforesaid.  And do hereby appoint my son Aaron Cadwell to be sole
Executor of this my last Will & Testament.  In testimony whereof I have

     The Distribution of the Estate of James Cadwell late of Farmington dec'd
as made by the subscribers is as follows:
     In the first place we set out to the widow a piece of wood land
containing 73 acres and is situated at the west end of the home lot beginning
at the NW corner of the home lot and running N-87-E 16 rods to a birch tree
marked thence  S-45-E to a heap of stones on the south line of s'd home lot
which heap of stones is 97 rods and 5 links eastward from the SW corner of the
home lot.  This piece of land is not distributed among the heirs.
     We also set to widow for her use and improvement a piee of land at the SE
corner of the home lot containing 6 acres bounds west on the Creek east on
Peletiah Collins land and is in width from the south line of the lot 27 rods
now this piece is on land distributed to Aron.
     Also set to the widow a piece of land in the home lot on the south side
containing 5 acres and is in width 5 rods and 18 links and bounds east on the
brook and extends west 140 rods this is on land distributed to Samuel.
     Also set to the widow a piece of land in the home lot containing 5 acres
1/4 and 33 rods and is the north [?] side of a piece of land set to James
bounds east on the brook and extends west 140 rods and is in width 6 rods and
6 links.
     Also set to the widow a piece of land in the home lot being the south
side of a piece of land distributed to Roger containing 7 acres and 4 rods and
is in width 8 rods and 2 links bounds east on the brook and extends west 140
rods also a piece being the south side of land set to Martin containing 5
acres 3/4 and 28 rods width 6 rods and 19 links bound east on the brook and
extends west 140 rods.
     Also set to the widow the north half of the House except the west half of
the buttery also 1/3 of the south cellar on the south side to be divided east
and west also 1/3 of the north cellar on the north side to be divided east and
west also the south end of the kitchen for the purpose of weaving.  She is
also to have the privilege of the oven for baking  also to pass and repass to
and from the house for wood and watter and for all other necessary purposes.
Also in the barn she is to have the south half of the bay to be divided east
and west and the south half of the floor  Also the 2 linters [?] east and
south of the barn also the south half of the cowhouse west of the yard also
the east part of the yard from the <smudge> to the nearest corner of the
linter south of the barn with the privilege of going to and from the barn and
to pass through the floor and to and from the cowhouse.
     Set to Aron the east end of the home lot containing 15 acres 3/4 and 14
rods it being all the land in the home lot lying east of the brook and
includes 6 acres set to the widow.
     Also set to Aron the Mountain lot so called containing 32 acres 1/4 and
28 rods.
     Set to Samuel a piece of land on the south side of the home lot
containing 25 acres and 1/2 bounds east on the brook and west on land set to
the widow width 13 rods and 23 links the piece includes 5 acres set to the
widow.  Also set to Samuel all the buildings.
     Set to James a piece of land in the home lot containing 27 acres and 1/2
including 5 acres 1/4 and 33 rods set to the widow bounds east on the brook
west on land set to the widow south on Samuel and north on Roger and is in
width 14 rods and 12 links except at one place which place is on the west side
of the road and extends from the road west 18 rods and 1/2 it is 2 rods less.
     Set out to Roger a piece of land in the home lot containing 36 acres
including 7 acres and 4 rods set to the widow bounds east on the brook and
west on land set to the widow and is the next piece north of James share and
is in width 17 rods and 17 links except on the west side of the road and
extending 18 rods and 1/2 west it is 2 rods more.
     Set to Martin a piece of land in the home lot on the north side
containing 43 acres 1/4 and 14 rods including 5 acres 3/4 and 28 rods set to
the widow and the spring lot so called.

viz:  I commit my body to the earth and my soul to God who gave it.  Item I
give and bequeath to my wife Mahala the use of one third of all my real estate
then after all my just debts including my funeral charges are paid, I give and
bequeath unto my oldest daughter Achsa, to my second daughter Rhoda, to my
third daughter Flora, to my fourth daughter Mary Ann & to my fifth daughter
Maria, all the remainder of my property, both real & personal, which is not
otherwise disposed of as above to be equally divided between the five children
above named.  I hereby appoint my brother Samuel Cadwell executor of this my
last will & testament.

Will:  I Mary Cadwell of Farmington in the state of Connecticut being in my
usual soundness of mind in view of the certainty of my death, and of the
uncertainty of the time of it--do make and appoint this at my last will and
testament
     First I command my soul to God through the perfect mediation of Jesus
Christ, trusting in his sovereignity, and hoping in his mercy.  And my body to
the dust to be buried in a decent Christian manner.
     The worldly property which God has been pleased to commit to me I devise
and bequeath in the following manner:  my just debts being first paid
     Viz To my honoured mother and my sister Huldah Tillotson and Naomi
Gridley I give & bequeath all the wearing appearal I may die possessed of, to
be divided between them equally:  or in case of the death of either of them
before my decease then the whole thereof to be divided equally to the survivor
of them.
     All my other personal property I may die possessed of I give and bequeath
to my said sister Naomi Gridley to be hers and her heirs.
     All my real estate I may die possessed of I give and bequeath to my
grandson Roderic Cadwell Steele if he shall live to the age of twenty one
years--then to be his and his heirs forever, but in case of his death before
he sahll arrive to the age of twenty one years, then I give and bequeath all
my said real estate to my sister Naomi Gridley to be hers and her heirs
forever.
     I also give and bequeath to my said sister Naomi Gridley the sole and
entire use and improvement of all my real estate, I may die possessed of,
untill my said grandson Roderic C. Steele shall arrive to the full age of
twenty one years.
     And I hereby appoint and constitute Orem Woodruff of s'd Farmington my
sole executor to this my last will and testament; declaring this to be my last
will and testament:  and hereby revoking any or all other as my last will and
testament.
     Pronounced and declared by the said Mary Cadwell as her last will and

Burial--and in touching those temporal things with which it has pleased God to
